Who Owns England?: How We Lost Our Green and Pleasant Land, and How to Take It Back

In England, land ownership is “our oldest, darkest, best-kept secret”. Guy Shrubsole, an activist for Friends of the Earth, has dedicated the last few years to uncovering who really owns the land. Using complex datasets from the Land Registry, freedom of information requests, and other tools available thanks to EU environmental rules, he has managed to lift the veil of secrecy: “The long-term concealment of who owns England appears to me to be one of the clearest cases of a cover-up in English history.” Shrubsole’s analysis shows how land that has been taken over generations, by conquest, by forced enclosure, by repression, continues to be protected by complicit (or cowed) governments, and that, despite the public perception that the gentry has fallen into decay and handed it all over to the National Trust, many of them are doing very nicely. It is common for UK pension funds and insurance companies to buy up land as a long-term strategic investment. Legal & General, for example, owns 1,500 hectares of land that it openly calls a “strategic land portfolio … stretching from Luton to Cardiff”. Its rationale for buying land is simple: “Strategic land holdings are underpinned by their existing use value [such as farming] and give us the opportunity to create further value through planning promotion and infrastructure works over the medium to long term.”

It reveals how the “decorative pomp and verbose flummery” with which the great estates are surrounded disguises this theft, and disguises the rentier capitalism they continue to practise. It explains how the landowners’ walls divide the nation, not only physically but also socially and politically. It shows how the law was tilted away from the defence of people and towards the defence of things. It shows how trespass helps to breach the mental walls that keep us apart.

Despite what I used to believe, the landed aristocracy remain remarkably adept at retaining their land and other assets - many have owned the same estates they acquired as part of the Norman landgrab in the 11th century. I was less surprised to discover that many landowners use off shore companies to avoid tax and hide their ownership, and trusts and other ruses to sidestep inheritance rules. But to really get under the skin of how companies treat the land they own, and the wider repercussions, we need to zoom in on the housing sector, where debates about companies involved in land banking and profiteering from land sales are crucial to our understanding of the housing crisis.

When once asked how young entrepreneurs might succeed in Britain, the late Duke of Westminster, Gerald Grosvenor (owner of 131,000 acres, including much of London’s Belgravia and central Liverpool), observed, drily, that they should “make sure they have an ancestor who was a very close friend of William the Conqueror”. Though Shrubsole estimates that the recent sell-off of ancestral lands to the “new money” of hedge-funders and oligarchs accounts for perhaps 17% of the total in England, 30% rests in the hands of the feudal Norman “cousinhood”, whose offspring have until recently preserved their birthright with a Downton-esque doggedness. I have to wonder, though, whether the Duke of Westminster in making his notorious comment was perhaps being a little coy or even trying to deflect attention away from the source of his great wealth, the Grosvenor Estate, comprising land that is now the ritziest part of London - Mayfair, Belgravia, Grosvenor Square and the rest of it. Farms owned by the Crown and wealthy landowners get hundreds of thousands of pounds every year in farm subsidies!!! Even when they're not actively farming, they just need to own the land, and the more land they own, the more dosh they get!!!!!!!! What a positively screwy system!!! Shrubsole's Lost Rainforests of Britain campaign attempts to find, map, photograph, and restore the Atlantic Oakwood forests, woodlands variously referred to in Britain as Upland Oakwoods, Atlantic Oakwoods, Western Oakwoods, Temperate Rainforest, Caledonian forest, and colloquially as Celtic Rainforests. [10] His book on the subject was shortlisted for the Richard Jefferies Society Literary Prize [11] and longlisted for the James Cropper Wainwright Prize for Writing on Conservation. [12]Shrubsole argues convincingly that land should be a common good used for the benefit of everyone. This requires a programme of land reform, similar to that which Scotland has pursued in the last 20 years, opening up access to land and introducing community buy-out legislation. There are now half a million acres in community ownership in Scotland, thanks to their land reform movement. This government seeks not to redress the imbalance, but to exacerbate it. Its proposal to criminalise trespass would deny the rights of travelling people (Gypsies, Roma and Travellers) to pursue their lives. It also threatens to turn landowners’ fences into prison walls. Last week I discovered illegal quarrying in part of the River Honddu in Wales. Had I not been trespassing, I would not have seen it and had it stopped. Criminalising trespass would put free-range people outside the law, and landowners above the law. There has, as a result, been some serious journalistic legwork in Shrubsole’s endeavour. An environmental campaigner for Friends of the Earth, he has used multiple freedom of information requests and a large network of crowdsourced informants and number crunchers to build up a credible picture of the pattern and detail of who owns what. Even so, he has come up against plenty of virtual Keep Out and No Trespassing signs, and some of his findings necessarily rely on best guesswork. It’s a book about the extent of ownership in absolute terms (who owns what percentage) but this really isn’t the point.
