About this deal

The UKAS process for assessing and accrediting asbestos inspection bodies was developed at the request of the Health and Safety Executive (HSE) in 2001. The subsequent pilot scheme was based on a programme to support the requirements of MDHS100 in non-domestic premises. Persons as defined under CAR 2012, Regulation 4 will require information, instruction and training to ensure they undertake their responsibilities to ensure compliance with CAR 2012. It is the duty holder’s responsibility to ensure that they appoint a competent organisation or person to undertake the asbestos survey. In practice, this means requesting references with respect to previous survey portfolios undertaken and ensuring that the organisation or surveyor appointed is accredited or certified by a third party. Organisations can demonstrate that they are technically competent to undertake surveys for asbestos containing materials (ACMs) through accreditation to ISO/IEC 17020. Individual surveyors can also demonstrate that they are technically competent to undertake specified surveys through holding ‘personnel’ certification from a Certification Body accredited by UKAS (United Kingdom Accreditation Service) for this activity under ISO/IEC 17024. The Duty Holder should not appoint or instruct an independent surveyor to carry out a survey unless the surveyor is competent.

The Survey must locate ACM that could be damaged or disturbed by normal activities, by foreseeable maintenance, or by installing new equipment. It involves minor intrusion and minor asbestos disturbance to make a Materials Assessment. This shows the ability of ACM, if disturbed, to release fibres into the air. It guides the client, eg in prioritising any remedial work. Refurbishment / demolition survey Section A2.8 of HSG248 (The Analysts Guide), states “ When the handling of asbestos-containing materials is frequent, airborne exposures should be assessed as required by CAWR. In any case, it is recommended that regular air monitoring (on a monthly basis) is conducted in the preparation/identification area, and that the results are recorded”.A material is guilty until proven innocent so if an area has not been inspected then asbestos must be presumed to be present. These should be detailed in the report. HSG264 states that if any ‘No Access’ areas are stated on your Management Survey then upon Re-Inspection – all ‘No Access’ areas on previous surveys (if available) must be accessed with suitable access equipment and procedures. Members agreed the numbers of 90 -150 samples is not possible and unfair treatment of analysts (which is what HSG248 was trying to avoid with the 40 points guidance). Members also agreed the upper limit does need to be considered. The process of a reinspection is (by strict definition) to re-assess the condition of previously identified asbestos containing materials (acms) only. Accredited IBs use standard methodologies to achieve this, as they would do in completing a normal management survey. Given survey methodologies are assessed by UKAS as part of the accreditation criteria, then an IB can produce a report in this instance which fulfils accreditation requirements.
