Hornby have today released the statement below regarding their proposed 'Trains on Film' train packs. In terms of trademarks, those extant before 01/01/2021 in Europe still hold value in the UK at the current time.

I’m not joining any boycott of Hornby for two reasons, there’s plenty of folks relying on their jobs in Hornby and if the Hornby model doesn’t duplicate someone else’s announcement and it’s something I wanted then it’s a nice to have. I doubt there would be any written clause or agreement between Studio Canal and Hornby that would undermine an existing exclusive agreement. However, I reckon Rapido will have sold all theirs and moved on to the model after the model after that, by the time it emerges.Comprising a 0-4-2 tank locomotive, RN 1401, Lowmac wagon with coach body load and a Western region brake van. This new train pack certainly looks to be a lot better than that one but maybe there's something linking the two, apart from them being about the same film? As well as having the benefit of most likely being the first to market, with their ‘Lion’ and ‘Thunderbolt’ models. Hornby also acknowledges and accepts that Studiocanal own the title rights to the films ‘Titfield Thunderbolt’ and ‘The Lady with a Lamp’.

So, possibly Rapido had decided to get the licensing issue nailed down *before* starting development work and publicity, whereas Hornby started development and then only belatedly thought to do their legal homework. Yes because as the Hornby Facebook has shown many are unaware of the other shenanigans behind all this. Boldly, and perhaps against the grain I'd predict that this will be a good move for Hornby once all the pitchforks have been put down.

Studio Canal and Rapido had a very public arrangement to produce models of the Titfield props in recognition of the 70th anniversary of the film. Whatever, the fact is that when Hornby finally got around to enquiring of Studiocanal about a TT licence they discovered that Rapido had beaten them to it months before. While this was going on, we also had to source drawings and images and to speak to owners of real vehicles.

It seems that Hornby have had a policy for some time of nipping in quickly when smaller manufacturers announce a new product to take some of their market share by producing the same thing themselves.

They have Tornado and Pullman coaches in their Railroad range, they (presumably) have the Lima 'Crab' and the circus train (which is freelance) could be made up of the usual Railroad curtain-sided vans and vent vans. I suspect that StudioCanal had a pre-existing arrangement with Rapido Trains for their Titfield products. Simon K has made it very clear in both Hornby series he’s going to go after ‘their models’, although how Lion fits that I don’t know, and he’s stepped across into making them seem like bullies rather than the victim with the antics as a result.

So they blast a load of their limited resources just to get it out before their competitor and generally it is not as good. Rapido publicly announced shortly after that they are making Lion and the Titfield Thunderbolt train packs (under licence from Studio Canal) for the 80th Anniversary of the film and had begun work on CAD etc. Terminator 2: Judgment Day, JFK, Basic Instinct, Cliffhanger, Under Siege, Free Willy, Stargate (movie).
